This Privacy Policy explains how The Luvart Platforms (Pty) Ltd ("we," "us," or "our") collects, uses, protects, and handles your personal information when you use Luvart.

Luvart is operated by The Luvart Platforms (Pty) Ltd, a company registered in South Africa. By using Luvart, you agree to the practices described in this policy.


1. Our Privacy Commitment

Luvart is an ad-free platform built on the philosophy of Ubuntu — the belief that your identity and your heritage are not products to be sold.

We make the following commitments to every user:

We are committed to compliance with applicable data protection law across all markets where Luvart operates.

Africa (Primary) — Our primary legal framework is the Protection of Personal Information Act, 4 of 2013 (POPIA) of South Africa. As we expand across the continent, we comply with applicable national data protection legislation in each African market.

India — We comply with India's Digital Personal Data Protection Act, 2023 (DPDP Act).

Mexico — We comply with Mexico's Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP).

Indonesia — We comply with Indonesia's Government Regulation No. 71 of 2019 and applicable personal data protection obligations.

If you are located in a country not listed above, we apply the standards of POPIA as a baseline minimum for all users globally.


3. Information We Collect

We collect only the minimum information necessary to provide a secure, functional, and culturally meaningful platform.

3.1 Account Data

When you create an account, we collect: name and username, email address, phone number (if provided), date of birth (to verify minimum age eligibility), and profile photo (if uploaded).

3.2 Content You Share

We store content you voluntarily create and share, including photos, videos, written posts, audio recordings, comments, reactions, and Cultural Circle contributions.

3.3 Technical and Security Data

To maintain platform security and stability, we collect IP addresses (pseudonymised in logs), device type, operating system version, app version, and session activity data managed via server-side Redis sessions — not browser cookies. This data is used strictly for security monitoring, fraud detection, and platform stability. It is not used for advertising or profiling.

3.4 Location Data

We collect location data only when you explicitly grant permission to enable specific features such as LuvMap. We collect approximate (coarse) location, not precise GPS coordinates, unless you choose to share a specific location with a post. Location data is not collected in the background and is not used for advertising.

Luvart recognises that cultural content — stories, indigenous language recordings, traditional knowledge, and oral heritage — carries community ownership, historical significance, and identity.

Your cultural content belongs to you and your community.

We do not use your data for advertising, behavioural profiling, or any purpose not listed above.


6. Technical Safeguards

Encryption in transit — All communication between the Luvart app and our servers is protected using TLS 1.3.

Encryption at rest — Sensitive personal data fields are encrypted at the column level using AES-GCM-SIV before being written to our servers.

Key management — Encryption keys are managed through a dedicated secure key management system and are never stored alongside the data they protect.

Authentication — Luvart uses JSON Web Tokens (JWTs) for authentication and server-side Redis sessions for session management. We do not use browser cookies.

No cookies — Luvart does not place any cookies — tracking, functional, or otherwise — on your device.


7. Data Sharing and Third Parties

We do not sell, rent, or trade your personal information. We may share limited data with third parties only in the following circumstances: legal obligations, imminent safety concerns, and infrastructure providers who process data on our behalf under contractual data processing agreements.

We do not share data with advertising networks, data brokers, or marketing platforms under any circumstances.


8. International Data Transfers

The Luvart Platforms (Pty) Ltd is headquartered in South Africa. Our primary servers serving African users are located in South Africa, ensuring that African user data remains on the continent. Any cross-border transfer of personal data is conducted in accordance with the requirements of POPIA and applicable local law.

10. Your Rights

Regardless of your location, we honour the following rights: right to access, right to rectification, right to erasure, right to data portability, right to object, and rights regarding automated decisions.

11. Children's Privacy

Luvart is intended for users aged 13 and older. We do not knowingly collect personal data from children below the applicable minimum age. If you believe a child below the minimum age has created an account, please contact us at khomotjo.ngobeni@luchsia.com.
